| Rental Terms & Conditions |
By using Quick Box kiosks, you agree to the following Terms and Conditions:
1. Each time you rent a movie/game from a Quick Box kiosk, you must swipe your credit or debit card. This means if you rent 2 movies, you will have swipe your credit or debit card 2 times.
2. By swiping a credit/debit card, you hereby certify to “First Data” that:
(a) you are 18 years of age or older;
(b) the card you are using is legally issued to you;
(c) and you agree to all these Terms and Conditions.
3. You are subject to these specific Terms and Conditions:
(a) You agree to be responsible for and guarantee payment to “First Data” of all charges related to the rental or purchase (including combined state and federal taxes);
(b) For each movie/game rented, a credit card pre-authorization in an amount not to exceed $30.00 will be obtained to ensure that you return the Product;
(c) The maximum amount of movies and games that a customer can have out of the kiosk at any point in time is three (3);
(d) If you return the movie/game within ten (10) minutes of the time of your rental, you will not be charged for the rental;
(e) If you rent the movie/game on any given day and return it the next day before 6:30 pm (Central standard time), you will be charged $1.99 (first night’s rental fee) plus taxes;
(f) You will also be charged $1.99 plus taxes for each additional day that you keep the movie/game;
(g) You will be deemed to have purchased the movie/game for the Replacement Cost if you do not return the movie/game within 14 days. After 14 days, you cannot return the movie/game nor can you receive a rebate of your Replacement Cost after this time period;
(h) You further authorize “First Data” to retain the debit/credit card information provided and submit credit card slips and owing to “First Data, including amounts owing for failure to return the movie/game or for damage to the movie/game.
4. You acknowledge that we have the right to conduct sales and/or rental promotions from time to time. As such, during the time Rental Terms and Conditions may be less than what is listed.
5. The Replacement Cost is currently calculated as $35.00 plus applicable sales tax(es) and is subject to change with market increases.
6. Rental charges and Replacement Cost charges do not include applicable goods and services tax or provincial sales tax. You will, in additional to the amounts owing to “First Data”, also pay to “First Data” the applicable Sales Tax.
7. Without limiting anything else in these Terms and Conditions, you will be charged for the Replacement Cost of the movie/game if:
(a) the movie/game is returned damaged including any tampering or damage to the RFID sticker;
(b) you do not return the original box or other materials in the box when you rent the movie/game.
8. If you choose to purchase the movie/game, or you are deemed to purchase the movie/game, the purchase will be on an “as is” basis. “First Data” makes no warranties for the merchantability or fitness of the movie/game for any particular purpose.
9. In no event will “First Data”, its affliates, agents, successors, directors, officers, employees or other representatives be liable for consequential, punitive or aggravated damages (including without limitation, damages for loss of data, income, loss of or damages to property and third party claims) or any other damages of any kind, arising out of or in connection with: your rental of the movie/game, your operation of the kiosk, “First Data’s” collection us usage of your credit/debit card information, return of the movie/game or any advertisement contained on this kiosk, whether or not “First Data” has been advised of the possibility of such damages. This exclusion of liability will apply to the fullest extent permitted by law. This provision will survive your purchase of the movie/game or your return on the movie/game.
10. You shall indemnify “First Data”, its affliates, agents, successors, directors, officers, employees, or other representatives from any damage or loss including, but not limited to, the kiosk, arising out of the use of the Kiosk or the purchase or rental of the movie/game.
11. This Agreement will be construed and governed by the laws of the jurisdiction where the kiosk is located and you and “First Data” submit to this exclusive jurisdiction.
